Terms and Conditions for ZINGO (Mobile and website e-commerce platforms)

Zingo is a platform that connects wholesalers to buyers. It allows seamless buying, delivery of the goods bought to users in a cheaper price. Zingo also allows you to buy airtime and data from the mobile application.

1. Introduction

Welcome to Zingo! These terms and conditions ("Terms") govern your access to and use of the Zingo mobile and web e-commerce application ("App"), the services provided by the App ("Services"), and the website associated with the App (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

2. User Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Platform.

3. Services

The Platform allows users to:

  • Purchase items in bulk and single units from various vendors.
  • Top-up airtime and data for mobile phones.

4. User Accounts

You need to create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to be fully responsible for all activities that occur under your account. Your account details are safely stored for the account of delivering your goods. On request, your account will be deleted. You can create a new user account at any time you want to purchase an item or buy airtime or data from the App.

5. Orders and Payments

  • When you place an order on the Platform, you are offering to purchase an item at the listed price.
  • We reserve the right to reject your order for any reason, including but not limited to: item unavailability, errors in pricing or product information, or fraud.
  • We accept various payment methods, which may be subject to change at our discretion.
  • You agree to pay all charges associated with your purchases on the Platform.

6. Delivery

  • Delivery times and costs will be displayed at checkout and may vary depending on the items purchased and your location.
  • We are not responsible for delays in delivery caused by factors beyond our control, such as weather or carrier issues.
  • In case of a delay, we may need to contact you directly by phone or email to arrange for a suitable time.

7. Returns and Refunds

Our return and refund policy is detailed in a separate document available on the Platform.

8. User Content

You may be able to submit reviews, ratings, or other content ("User Content") to the Platform. You are responsible for the accuracy and completeness of your User Content. You warrant that you have all necessary rights and licenses to submit User Content to the Platform.

9. Intellectual Property

The Platform and all content and materials on the Platform, including trademarks, copyrights, and patents, are protected by intellectual property laws. You agree not to use any content or materials on the Platform for any commercial purpose without our written consent.

10. Disclaimer

The Platform and Services are provided "as is" and without warranties of any kind, express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

We will not be liable for any damages arising out of your use of the Platform, including but not limited to direct, indirect, incidental, consequential, or punitive damages.

12. Termination

We may terminate your access to the Platform at any time and for any reason, with or without notice.

13. Governing Law

These Terms will be governed by and construed in accordance with the laws of Kenya.

14. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the Platform.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

16. Changes to Terms

We may change these Terms at any time by posting the revised Terms on the Platform. You are responsible for checking the Terms periodically for updates. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the revised Terms.

We may update this Privacy Policy from time to time to reflect changes in our data practices. Any updates will be posted on this page, and the "Effective Date" at the top will be updated accordingly.
